DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Dallas County

Dean Sweeney

Cease all illegal open burning; comply with applicable laws in the future; and pay a $3,500 administrative penalty.

Greene County

Crosman Land and Livestock, LLC

Implement the facility's Plan of Action; ensure the manure basin is maintained at all times, making frequent inspections and repairs as needed; monitor the liquid levels in the basin; monitor the monitoring port associated with the groundwater lowering tile and pump the water to the surface of the ground when needed; and pay a $4,000 administrative penalty.

Hardin County

Hand Nutrients Management, L.L.C.

Develop and submit a Standard Operating Procedure (SOP) for manure application, which shall include employee transportation training; immediately implement the SOP upon approval; and pay a $2,500 administrative penalty.

Lyon County

City of Doon

Cease all illegal discharges to waters of the state; submit a compliance plan that identifies the actions to be taken to address the chloride effluent limit violations; give each identified action a performance date; all actions shall be completed no later than June 30, 2026; and pay a $2,000 administrative penalty.

Sioux County

Jochum Agri-Services, Inc.

Submit proof of manure application Standard Operating Procedure (SOP) employee training for the previous five years; develop an updated SOP for manure application, which shall include mandatory reporting of manure releases; submit and immediately implement the SOP upon approval; and pay a $5,000 administrative penalty.

Tama County

Duane Woebbeking

Only apply manure in accordance with the facility's manure management plan; and pay a $2,500 administrative penalty.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.
