DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Jones County

Energy Mfg. Co., Inc.

Comply in the future with all applicable permitting and record-keeping requirements, including keeping all permits and required records available at the facility in an organized manner; obtain permit modifications prior to beginning construction and operation of new or modified emission points; and pay a $5,000 administrative penalty.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.

Kossuth County

Bar BQ Pork L.L.C.

Pay a $3,000 administrative penalty.

Osceola County 

Travis Dagel

Submit the 2024 Manure Management Plan update and compliance fee; and pay a $3,000 administrative penalty.

Van Buren County

Troy Sedore

Cease operating a solid waste transfer station or a recycling center unless pursuant to a valid permit; remove and lawfully dispose of all remaining solid waste at the facility, including tires, ash, and other waste residue from open burn activities; submit proof of lawful disposal via receipts and photographs; comply with solid waste disposal and open burning laws; cease discharging pollutants to a water of the state; excavate contaminated soil on site and submit proof of lawful disposal; and pay a $10,000 administrative penalty.
