DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Buchanan, Clayton and Fayette Counties

Nick Thole

Obtain additional continuing education units; submit proof of ethics training; submit daily bench sheets along with monthly operating reports; verify a plan for required testing to occur during any future work absences; obtain written approval prior to providing any certified operator services to another facility; and violations shall result in a one-year suspension.

Marshall County

City of Laurel

Complete necessary facility upgrades and modifications by May 2027 to comply with its National Pollutant Discharge Elimination System permit; and pay a stipulated $1,000 administrative penalty.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.

Cherokee County

Adam Timmerman

Pay a $3,000 administrative penalty.

Davis County 

Paul and Charlotte Teubel

Comply with solid waste and tire disposal laws and rules; properly dispose of all remaining tires and submit disposal receipts; allow follow-up inspection of the property; and pay a $10,000 administrative penalty.

Dubuque County

Precision Custom Pumping LLC

Develop and submit a standard operating procedure (SOP) for manure application, that shall include terms on equipment inspection and a response procedure for equipment failure; submit the SOP for approval and immediately implement upon approval; and pay a $2,000 administrative penalty.

Emmet County

Tanner Oleson

Pay a $3,000 administrative penalty.
