DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Find the entire, original orders on DNR’s website.

Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Adair and Guthrie Counties

Kading Land Co.

Comply with spill prevention, control, and countermeasure regulations; properly maintain and keep in good working order all storm drains associated with the fuel tank's secondary containment; promptly notify local authorities of all future hazardous conditions; and pay a $6,500 administrative penalty.

Henry County

Heigh Ho Farms Inc.

Pay a $2,000 administrative penalty.

Winnebago County

Central Disposal Systems, Inc.

Comply with solid waste disposal laws and landfill laws, including the daily cover requirements; for a period of six months, inspect the landfill on a weekly basis for leachate seepage and maintain a log of inspections, which shall be provided upon request; and pay a $10,000 administrative penalty.

Administrative Orders

Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.
