DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Cedar County
Allen Wiese
Ensure that only property certified manure applicators handle manure at the animal feeding operation; and pay a $3,000 administrative penalty.
Kossuth County
Berte Pumping LLC
Ensure that all future handling, transferring, and land application of manure is done in accordance with law and does not cause water quality violations; and pay a $5,000 administrative penalty.
Woodbury County
Seaboard Triumph Foods, LLC
Submit air quality construction permits for Boilers 1, 2 and 3 and the biogas flare; cease sending biogas to Boiler 1 until issuance of the air quality construction permits and send all biogas to the biogas flare, and only use natural gas as fuel for Boiler 1; comply with all permitted limits in effect no later than Dec. 31, 2025, including any modified stack parameters; track all biogas consumed in the flare monthly along with hours of operation; send a biogas sample on the 10th day of the month to a laboratory for analysis consistent with ASTM D 5504-12; report excess hourly sulfide dioxide emissions from the flare and/or boilers; submit hydrogen sulfide sampling results by the 15th of the month; track facility-wide natural gas consumption/usage monthly utilizing the biogas and natural gas meters; conduct stack tests within 90 days of the issuance of air quality construction permits for Boilers 1, 2, and 3; submit monthly compliance reports on all requirements of the administrative consent order; and pay a $7,000 administrative penalty.
