DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Henry County
City of Winfield
Complete construction of the necessary upgrades to its wastewater treatment facility by Sept 1, 2025; provide progress reports every six months and pay a $4,500 administrative penalty.
Jones County
Kodiak Property Management, Inc and Fawn Creek MHC, LLC
Send at least one primary employee to a three-day asbestos inspector course and submit proof of completion; comply with all asbestos regulations in the future; and pay a $8,400 administrative penalty.

Pro Platinum Construction and Remodeling, LLC
Send at least one primary employee to a three-day asbestos inspector course and submit proof of completion; comply with all asbestos regulations in the future; and pay a $4,000 administrative penalty.
Polk County
Home Depot U.S.A. Inc.
Conduct stormwater training of paint department and garden center management and associates at Store No. 2103; submit proof of training; and pay a $5,500 administrative penalty.
Tama County

Retain at all times an operator-in-charge of its wastewater disposal system who has a valid Grade III wastewater treatment certification.
Administrative Orders
Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.

Hire a permitted asbestos abatement company to supervise, remove, and dispose of the asbestos containing material at the property and properly dispose of at a permitted landfill; submit disposal recipes; have a licensed asbestos inspector conduct a thorough asbestos inspection at the property prior to further renovation work; comply with all asbestos regulations in the future; and pay a $10,000 administrative penalty.
