DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Administrative Orders
Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.

Benton County
Brad Zieser
Submit a complete Iowa Phosphorus Index Manure Management Plan (MMP) to the Department; pay $144 in overdue MMP fees; and pay a $3,000 administrative penalty.

Cass, Hamilton, and Jasper Counties
Global Fiberglass Solutions, Inc.
Immediately cease speculative accumulation of wind turbine blades; and properly dispose of in, or remove from, the state all blades currently stockpiled.

Dubuque County
Larrell DeJong
Operate and maintain the facility and all other animal feeding operations in compliance with applicable law; develop and implement a plan of action approved by the DNR to prevent all future releases of manure; and pay a $4,000.00 administrative penalty.

Kossuth County
North Iowa Custom Finishing
Pay the remaining $2,250.00 penalty assessed by Administrative Consent Order 2019-AQ-10; and pay a $4,100 administrative penalty.

Osceola County
Mel’s Pit Service, LLC
Refrain from conducting business in the state of Iowa unless both the business and employees are properly certified as a commercial manure service; and pay a $500 administrative penalty.

Scott County
Thomas May and Timber Industries, LLC
Develop a plan of action to prevent future prohibited discharges to a water of the state and submit the plan to the Department for approval; submit a complete application for a stormwater discharge permit within 30 days; and pay a $10,000 administrative penalty.

Taylor County
Jason Larabee
Apply manure in compliance with all applicable laws; develop and implement a plan of action approved by the DNR that will prevent future non-permitted discharges to a water of the state; and pay a $7,500 administrative penalty.
