DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Scott County
Ven Green Land Development, LLC
Comply with all conditions of its National Pollution Discharge Elimination System permit, to include the Storm Water Pollution Prevention Plan and pay a $6,000 administrative penalty.
Story County
Amy Kohlwes
Affidavit operator statuses for the City of McCallsburg and City of Zearing's respective water and wastewater systems are revoked; and comply with terms of a one-year probation for all DNR-issued water treatment and/or distribution and wastewater treatment licenses.
Webster County
Frank's Auto & Truck Salvage, LLC
Submit an application for a storm water permit and refrain from operating until a storm water permit is obtained; submit an application for an appliance demanufacturing permit (ADP) and refrain from accepting or processing any appliances until the ADP is obtained; post signs on the property until the ADP is obtained that notify the public that appliances cannot be dropped off; and pay a $6,625 administrative penalty.

The city shall submit plans and specifications for upgrades to its wastewater treatment facility by Aug. 30, 2021; shall issue a contract for the construction of upgrades by Dec. 30, 2021; and shall comply with final limits in its most current National Pollution Discharge Elimination System permit by Dec. 21, 2022).
