DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Allamakee County
City of Waukon
Comply with all laws regulating the discharge of pollutants into a water of the state; develop a plan of action to prevent future unpermitted discharges into a water of the state and submit the plan to the Department for approval; once approved, implement the plan within 60 days; pay $1,568.60 in restitution and investigative costs; and pay a $2,500 administrative penalty.

Ida County
Fredco, Inc.
Develop and implement a standard operating procedure for the proper land application of effluent from the facility and submit to the Department for approval; once approved, immediately implement the plan; and pay a $8,000 administrative penalty.
