DNR enforcement actions

DES MOINES -- DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions.

Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Butler County
GJL Real Estate, LLC
Develop and submit to DNR a nutrient management plan (NMP); maintain the NMP and update it as needed; submit to DNR a complete copy of the updated NMP every five years; and pay a $3,000 administrative penalty.

Story County
Scott Peterson
Comply with a six-month suspension of Grade III certification in wastewater treatment; notify DNR prior to employment at a wastewater treatment or drinking water facility; participate in quarterly evaluations during a 12-month probation following such employment; and refrain from being the directly responsible operator in charge at any wastewater or drinking water facility for the first six months of probation period.

Worth County
New Heaven Chemicals Iowa, LLC
Pay $17,914.25 in overdue construction permit application fees and Title V Emission Inventory fees in six monthly installments beginning in October 2020.
