DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Buena Vista County
Mangold Environmental Testing, Inc.
Amendment to Consent Order 2018-WS-07.  Expands the scope of the temporary suspension to include compliance sampling.

Butler County 
TEDE Farms, L.L.C.
Operate in compliance with the rules and regulations; develop and implement a Standard Operating Procedure for monitoring a depopulated facility; and pay an administrative penalty of $500.

Dubuque County 
T&K Pumping
Operate in compliance with rules and regulations; develop and implement a Standard Operating Procedure for monitoring land application; and pay an administrative penalty of $3,000.

Henry County
Raymond Francis
Revocation of Mr. Francis' drinking water treatment and drinking water distribution certifications; prohibited from holding any DNR certification for drinking water treatment, drinking water distribution, and wastewater treatment; and pay an administrative penalty of $1,000.

Lyon County
Linwood Mining and Minerals Corp.
Decommission certain equipment; maintain records; and pay an administrative penalty of $10,000.

Pottawattamie County
RJS Custom Enterprises, LLC
Operate in compliance with rules and regulations; develop and implement a Standard Operating Procedure for employee certification; and pay an administrative penalty of $3,500.

Sioux County
Jerry Reuvers
One year probation for Mr. Reuvers' certifications and operator-by-affidavit in drinking water treatment, drinking water distribution, and wastewater treatment; and no involvement in lead and copper sampling for one year.

Scott County
Jochum Agri-Services, Inc.
Ensure proper manure application and develop and implement Standard Operating Procedure for employee training.

Woodbury County
American Pop Corn Company
Obtain air quality construction permits prior to construction; conduct an audit at the facility; and pay an administrative penalty in the amount of $10,000.

Wright County
DMC Property Rentals, LLC
Operate in compliance with rules and regulations; install a riser in the earthen basin; and pay an administrative penalty of $500.

 

Administrative Orders
Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

Butler County 
Scott Heise dba Tricounty Tree Pros
Amendment to Administrative Order 2017-AQ-27. Rescinds original administrative penalty and requires a penalty in the amount of $500.

Decatur County
Travis Erwin
Requires compliance with open burning solid waste regulations in the future; requires proper disposal of any remaining waste at the property; and assesses an administrative penalty of $1,600.
