DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Appanoose County
Jerry Fetters
Cease open burning and open dumping of solid waste tires, properly remove all remaining tires, and pay $1,500 penalty.

Audubon County
Waspy’s Truck Stop, LLC
Cease illegal discharges to waters of the State, comply with all conditions of NPDES General Permit No. 2 and pay $5,000 penalty.

Dubuque County
John Hoefler
Pay $22,417 in fish restitution and investigative costs and $2,000 penalty for manure discharge at facility. Order also requires the submittal and implementation of a plan to ensure future discharges do not occur at facility.

Fayette County
Raymond Forsyth Farms Corp
Pay $2,000 penalty and $4,910 in fish restitution and investigative costs as a result of a manure discharge at facility. Penalty also includes violations relating to improper demolition of a building at the facility.
