DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Jasper County
Mark Samson
Permanent revocation of all water treatment, wastewater treatment and drinking water distribution certifications and prohibition against holding any further DNR wastewater treatment, drinking water treatment or water distribution certifications.

Plymouth County
LCNJ Farms, Inc
Submit and implement Plan of Action to prevent future discharges from facility and pay $7,000 penalty.

 

Administrative Orders
Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

Johnson County
Central States Coatings, Inc.
Cease unauthorized discharges of pollutants to municipal storm sewers or waters of the state and pay $10,000 penalty.

Polk County
GATR of Des Moines Inc.
Pay $1,500 penalty for late submittal of 2016 Minor Source Emission Inventory.
