Additional Opportunity for Public Comment on Proposed Air Quality Rulemaking

On July 18, 2017, the Environmental Protection Commission (Commission) approved an additional opportunity for public comment on a proposed air quality rulemaking. The Iowa DNR Air Quality Bureau (DNR) received one comment on the original Notice of Intended Action, and is accepting additional comments through August 17, 2017. The DNR did not make any changes to the proposed rules from what was published in the original Notice of Intended Action.

How to Provide Comments: Anyone may make written suggestions or comments on the proposed amendments no later than 4:30 p.m. on August 17, 2017. A public hearing will be held on Thursday, August 17 at 10:00 a.m. in the conference rooms at the Department’s Air Quality Bureau office located at 7900 Hickman Road, Windsor Heights, Iowa.

Proposed Rulemaking: The proposal will amend requirements for submitting construction and Title V operating permit applications to clarify the types of mailing services that may be used to submit applications and that applications are not required to be submitted by certified mail. The proposal also describes what constitutes a valid electronic signature for permit applications submitted electronically and would establish electronic media submission requirements necessary for compliance with the federal Cross Media Electronic Reporting Rule adopted in Chapter 15 of Iowa Administrative Code 567.

The proposal includes reduced regulatory burden for construction permit applicants for projects that will not emit Greenhouse Gases (GHG) by eliminating the requirement to submit the current three-page GHG form. Applicants would instead be able to indicate that the application includes no GHG emissions in the project description. Additionally, the required number of submitted copies of the Title V application is being reduced from two copies to one copy.
