DNR Enforcement Actions

DES MOINES – The DNR has taken the following enforcement actions. The following are only briefs; copies of enforcement action, including the full, original order and contact information are available on the DNR’s website at https://www.iowadnr.gov/About-DNR/About-DNR/Enforcement-Actions

 

Administrative Orders

Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

 

Lucas County

Water Board, Chariton Municipal Water Works

The order requires the water board to comply with federal and state drinking water regulations, to submit a compliance schedule or connect to an alternate source of drinking water, and to pay a $10,000 penalty.

 

Consent Orders

A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

 

Mahaska County

Mahaska County Solid Waste Management Commission

Compliance schedule to return landfills to compliance with applicable requirements of Iowa law related to operation and maintenance of sanitary landfills. Stipulated penalties included for noncompliance with order.

 

Hamilton County

Paul Sealine

Install improvements at the facility to prevent future manure discharges to waters of the state and pay $1,500 penalty. Stipulated penalties also included for noncompliance with order.

 

Kossuth County

Kenneth and Marlene Banwart Revocable Trust; Hogwart, LLC; Trent Banwart; Banwart Finisher

Submit manure management plan update and fees and pay $3,000 penalty.

 

Van Buren County

Sedore Inc. dba Sedore Sanitation and Recycling

Order authorizes revocation of transfer station permit and closure of the facility and payment of $10,000 penalty. Order also resolves earlier appeal.

 

Consent Amendments

A consent amendment is issued in settlement of a previous administrative order or to amend a pre-existing consent order. A consent amendment indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

 

Dubuque County

William Lawler and Jeff Lawler

Amended compliance schedule; payment of fish restitution and investigative costs of $1,118; and, payment of $6,000 penalty. Order also resolves earlier appeal.
