DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Polk County

Hy-Vee, Inc.

Comply with all laws and regulations applicable to discharging pollutants into a water of the State; apply for a National Pollutant Discharge Elimination System (NPDES) general permit No. 1 for the Ankeny #1 store; conduct and document employee training on compliance and implementation of the NDPES permit; conduct a risk assessment of all Hy-Vee stores and develop emergency response plans and document the staff who are familiar with its implementation; pay fish restitution and investigation costs of $18,929.98; and pay a $5,200 administrative penalty.
