DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Shelby County
Gary Nielsen 
Submit a manure management plan and a construction design statement with supporting documentation to the Department; submit required filing and indemnity fees and pay overdue compliance fees for 2017 through 2020; and pay a $1,500 administrative penalty.

 

Administrative Orders
Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.

Polk County
Tyler Investments Co., Inc. d/b/a Oakwood Heights Mobile Home Park
Maintain and operate all wastewater treatment and collection systems (systems) under its control in a manner that complies with applicable laws; cease all non-permitted discharges; obtain a professional evaluation of the integrity and operational capacity of its systems; timely complete any professionally-recommended improvements to the systems identified in the evaluation; and pay a $10,000 administrative penalty.
