DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Cerro Gordo County
Jeff Moellers
Operate in compliance with applicable laws, pay a $1,000 administrative penalty.

Cherokee County
Robert Bryant dba Grand Meadow Feeders
Operate in compliance with applicable law, monitor the stockpile during wet conditions to ensure the retention of all manure, pay a $2,000 administrative penalty.

Clayton County
Gary and Darlene Kregel
Operate in compliance with applicable laws, develop and submit a plan of action for manure storage and stormwater controls, pay a $3,600 administrative penalty.

Hamilton County
City of Blairsburg
Consent Amendment to Administrative Order 09-WW-07. Award contract and complete construction of previously agreed to wastewater improvements by specified dates.

Howard County
Mary Jo and Doug Engle dba Jo's Longbranch Bar and Grill
Comply with public water supply system permit and pay permit fees, comply with previously-issued administrative order, and pay a $4,500 administrative penalty.

Kossuth County
Keith and Krystal Johnson (Butler Sow Farms, LLP)
Operate in compliance with applicable laws, submit a complete MMP with an Iowa Phosphorus Index, pay a $3,000 administrative penalty.

Louisa County
Casey's General Store, Inc.
Comply with public water supply system permit and pay a $4,400 administrative penalty.

Muscatine County
Richard and Dorothy Tompkins
Consent Amendment to Administrative Order 19-AQ-26/19-SW-14.  Amended the administrative penalty to $2,400

Scott County
Chisagkumar Patel (Cody Mart)
Comply with all applicable laws, pay a $4,000 administrative penalty.
