DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Sioux County
Farmers Co-Operative Society, Sioux Center, Iowa dba Farmers Co-Operative Society and FCS Cooperative

Develop a standard operating procedure to assure storage of mineral oil and pay a $5,000 administrative penalty.

Lyon County
Dave Van Beek

Operate feedlots in compliance with all laws and regulations, do one of the following: submit an NPDES permit application or submit and implement plans for interim and permanent measures to eliminate discharges to a water, and pay a $5,000 administrative penalty

 

Administrative Orders

Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

Washington County (This is the one from last week that hasn’t been published yet)
Dennis Grimm

Hire of Certified Groundwater Professional, initiate free product recovery and reporting, conduct annual site monitoring and reporting, establish long-term action plan to address high risk receptors and bring the site to closure, and pay a $9,000.00 administrative penalty.
