DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Black Hawk County
Jon Matteson
Revoke Mr. Matteson's water treatment, drinking water distribution and wastewater treatment certifications and Mr. Matteson is not allowed to hold any DNR certifications in the future.
Clinton County
Waste Management Agriculture Services LLC
Operate in compliance with the rules and regulations; Ddvelop and implement a Standard Operating Procedure to ensure proper land application; company on probation for 3 years; and pay a $10,000 administrative penalty.
Lucas County
Oleg Sharpelyuk
Stop all illegal open burning, properly dispose of solid waste in the future, submit disposal receipts for remaining solid waste on the property, and pay a $5,000 administrative penalty.
Polk County
Airgas USA, LLC
Comply with all rules and regulations, implement a Plan of Action for tank monitoring and pay an administrative penalty in the amount of $5,000.
Webster County
New NGS, Inc. dba National Gypsum Company
Submit excess emissions reports, provide names of those responsible for recording excess emissions, provide training to those responsible for recording excess emissions. Develop and submit preventative maintenance plan, submit air quality construction permits, submit progress report on replacement activities, complete installation of burners by June 1, 2020. Conduct all required stack testing; If stack tests indicate emissions over the Title V limits, submit a Title V operating permit application, and pay a $10,000 administrative penalty.
