DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Brant Lemer
Amendment to Consent Order 2017-AQ-19.  
Cease illegal open burning; comply with the asbestos provisions; provide documents on what asbestos containing and non asbestos material has been removed and where the material of taken; remove and properly dispose of all non asbestos material and asbestos containing material from the property; pay for $1900 in past notification fees; remove the administrative penalty.

 

Administrative Orders
Responsible parties have 30 days to appeal the order or 60 days to pay the penalty.

Ram Development, LLC
Amendment to Administrative Order No 2018-AQ-24.  
Cease illegal open burning; comply with terms of construction permit; modify Title V permit to include O&M plan; comply with opacity limits; and pay an administrative penalty in the amount of $5,000.
