DNR Air Quality to Provide a Fact Sheet on Major Source Reclassification Under Section 112 of the Clean Air Act

The Iowa DNR has developed a fact sheet to provide additional clarification concerning the U.S. Environmental Protection Agency’s (EPA’s) new guidance memorandum titled “Reclassification of Major Source as Area Sources Under Section 112 of the Clean Air Act”. This memo withdrew the “once in always in” policy and allows major sources of hazardous air pollutants (HAPs) to be reclassified as area sources for the purposes of National Emission Standards for Hazardous Air Pollutants (NESHAP).  

The fact sheet summarizes the memorandum’s guidance and provides implementation assistance. It presents the requirements for reclassification and issues facilities should consider before applying for permit and classification changes. It also provides the necessary actions facilities need to take to reclassify, how the DNR can assist, and where to obtain additional information.
