DNR enforcement actions

DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Emmet County
Duane and Kaylene Linn
Requires compliance with open burning solid waste regulations in the future; requires proper disposal of any remaining waste at the property; and assesses an administrative penalty of $2,000.

Iowa County
Thomas Scott Dodge and Ronald Schintler
Remove waste tires as scheduled and no additional tires stored on the property.

Louisa County
City of Columbus Junction
Establishes a time frame for wastewater treatment facility improves and assesses an administrative penalty of $1,000.

Scott County
Timber Industries, LLC
Requires the submittal of a storm water discharge permit application; requires the submittal of a plan on how the discharge will be eliminated; establishes a date for the discharge to be eliminated; and assesses an administrative penalty of $4,500.

Story County
Landus Cooperative
No further unlawful discharges; submit a training plan to the field office; and pay an administrative penalty of $5,500 and restitution in the amount of $8,852.11.

Washington County
Brenneman Pork, Inc. and Brenneman Family Farms, LLLP
Requires requires compliance with all animal feeding regulations in the future; requires the submittal of Standard Operating Procedures for land application and assesses an administrative penalty of $1,000.

Winneshiek County
Kevin Moellers and Gayleen Moellers dba KG4 Farms
Requires compliance with all animal feeding regulations in the future; requires the submittal of Plan of Action to prevent future discharges; and assesses an administrative penalty of $1,500.
